10 Day Rule Florida
A driver’s license will automatically suspended if the driver suspected of DUI refuses to take the breath or blood test. After being arrested for a DUI a driver must report to the DHSMY within 10 Days of the arrest to request a Formal Review Hearing to challenge the driver’s license suspension. Drivers can also choose to waive the hearing and move directly to a review for eligibility for a restricted license.
If you do not request an administrative hearing within 10 Days of your arrest, your privileges will be automatically suspended.
When you are arrested for DUI, you must face two difference actions, one involving the criminal case and one involving your driving privileges.
